# Term of Service

Welcome to **SurfLayer** (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the SurfLayer ecosystem — including our website, APIs, decentralized cross-chain protocol, and related services (“Services”).

By accessing or using SurfLayer, you acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our **Privacy Policy**.

### **1. Eligibility**

By using SurfLayer, you confirm that:

* You are at least 18 years of age, or above the legal age of majority in your jurisdiction.
* You have the full legal capacity to enter into binding agreements.
* You are not located in, or a resident of, any jurisdiction that is sanctioned or restricted under **OFAC**, **FATF**, or **EU** regulations.
* You comply with all applicable local and international laws when using SurfLayer.

### **2. Description of Services**

SurfLayer is a next-generation **cross-chain swap and interaction protocol** that enables users to perform **fast, secure, and low-cost digital asset transfers** and on-chain actions across heterogeneous blockchain networks.

#### **Key Features**

* **Smart Contract-Free Architecture:** Reduces security risks by minimizing contract dependency.
* **Ultra-Fast Execution:** Swaps and interactions complete in under one minute under optimal conditions.
* **Low Fees:** Dynamic routing and optimization ensure the lowest transaction costs possible.
* **Liquidity Independence:** SurfLayer maintains its own liquidity reserves, ensuring user funds remain fully under their control.
* **Transfer Limits:** Built-in thresholds protect users from excessive risk and authorization exposure.

### **3. Wallet Connection & Usage**

* Users may connect Web3 wallets (e.g., **MetaMask**, **WalletConnect**, **Ledger**) to interact with SurfLayer’s on-chain protocol.
* SurfLayer is strictly **non-custodial** — users retain full control over their wallets, private keys, and digital assets.
* Users are solely responsible for verifying transaction details before signing or confirming any on-chain action.
* SurfLayer never requests or stores private keys, seed phrases, or wallet passwords.

### **4. Social & Third-Party Account Connections**

Certain SurfLayer features (e.g., **quests, waitlists, referral programs**) may require linking third-party accounts such as **X (Twitter)**, **Discord**, or **Gmail** for identity verification or participation tracking.

* These integrations are used **solely for authentication and engagement verification purposes**.
* SurfLayer does **not collect, store, or process personal information** (such as names, emails, contacts, or messages) from these platforms.
* No data beyond minimal verification tokens is retained, and SurfLayer does not gain access to any private content from your connected accounts.

### **5. Transaction Fees & Limits**

* All protocol fees are displayed transparently before each transaction or interaction.
* Transaction limits may be applied to minimize exposure during periods of network instability.
* **Blockchain gas fees** are independent of SurfLayer and cannot be modified or influenced by the platform.

### **6. User Responsibilities**

By using SurfLayer, you agree to:

* Use the protocol at your own risk and discretion.
* Secure your wallet credentials, private keys, and recovery phrases.
* Access SurfLayer only through official and verified domains.

* Using SurfLayer for **money laundering, terrorism financing, sanctions evasion, or illicit asset transfers**.
* Interfering with, disrupting, or degrading the performance of SurfLayer’s Services or networks.

### **8. Limitation of Liability**

To the maximum extent permitted by applicable law:

* SurfLayer is not liable for any direct, indirect, incidental, or consequential losses resulting from blockchain network failures, token volatility, forks, or third-party vulnerabilities.
* SurfLayer’s total cumulative liability shall not exceed the total protocol fees paid by the user within the preceding **90 days**.

### **9. Disclaimers**

SurfLayer is provided on an **“AS IS”** and **“AS AVAILABLE”** basis.

* We make no representations or warranties regarding transaction success, uptime, or market stability.
